Gomez Trial Attorneys represents Stephanie Hoffman for injuries she sustained at or about 11601-11757 Aspendell Drive, in the City of San Diego, California 92131, on January 29, 2020. Enclosed is a Designation of Representation.

It is our understanding that the area of Aspendell Drive where Ms. Hoffman was injured is within the Scripps Highlands Homeowners Association. As such, I am requesting a copy of the following documents [or documents containing the following information] be provided to me:

 

  • Any and all documents that constitute contracts between Scripps Highlands Homeowners Association and the City of San Diego.
  • Any and all documents that constitute memorandums of understanding between Scripps Highlands Homeowners Association and the City of San Diego.
  • Any and all documents that constitute agreements between Scripps Highlands Homeowners Association and the City of San Diego related to the maintenance of roadways, sidewalks, and other areas within the Scripps Highlands Homeowners Association location.
  • Any and all documents, including applications, evaluations, and/or agreements regarding subdivision approval by the City of San Diego to Scripps Highlands Homeowners Association.
  • Any and all documents demonstrating Scripps Highland Homeowner Association's duty and/or responsibility to maintain roadways, sidewalks, and other areas within the Scripps Highlands Homeowners Association geographical location.
  • Any and all documents related to Scripps Highland Homeowner Association establishment of private subdivision roads within the Scripps Highlands Homeowners Association geographical location.
  • Any and all declarations of a common interest development submitted by Scripps Highlands Homeowners Association to the City of San Diego.
  • Any and all declarations of Covenants, Conditions and Restrictions (CC&Rs) submitted by Scripps Highlands Homeowners Association to the City of San Diego.
  • Any and all building permits related to any Scripps Highland Homeowner Association maintenance projects for repair of sidewalks from 2015 - present.
  • Any and all requests for repair for sidewalks by Scripps Highland Homeowner Association to City of San Diego from 2015 - present.

“Public records" that are subject to inspection and copying under the California Public Records Act (CPRA) include any writing containing information relating to the conduct of the public's business prepared, owned, used, or retained by any state or local agency regardless of physical form or characteristics. (Gov. Code §6254, subd. (e).) Public records within the coverage of the California Public Records Act are open to inspection at all times during the office hours of the state or local agency, and every person has a right to inspect any public record except as statutorily provided. Any reasonably segregable portion of a record must be available for inspection by any person requesting the record after deletion of the portions that are exempted by law. (Gov. Code §6254, subd. (e).) The fact that a public record may contain some confidential information does not justify withholding the entire document; if only part of a record is exempt, the agency is required to produce the remainder if segregable. (County of Santa Clara v. Superior Ct. (2009) 170 Cal.App.4th 1301.)

As the authorized representative of Ms. Hoffman, we are entitled to receive the above described documentation and information. (Gov. Code §6254, subd. (f)(l).)

I ask that my request receive expedited processing if at all possible because my client was severely injured and must exercise her legal rights to secure publicly-held information related to the injuries she sustained on January 29, 2020. I am willing to pay fees for this request as appropriate under your processing charges.
