Subject: Public Records Act Request Re: Solicitation  K-19-1704-DBB-3 for Plaza de Panama Jacobs Project.

Dear Madam Clerk, San Diego City Attorney and Mayor Faulconer: 

I am requesting and demanding information pursuant to the Public Records Act, California Government Code Sections 6250-6270. I request your full, responsive, good-faith and complete production be accomplished within the ten - day statutory period mandated by controlling California law.  

The following Defined Terms will be used uniformly in this Request:

  1.  "Documents" shall mean all physical writings and electronic records of communications, minutes, agendas, correspondence, and office calendars and schedules of meetings, minutes and notes of meetings. including but not limited to letters, Post Cards, message notes and slips, phone message notes and slips, drafts [including ALL draft versions] and final Memoranda, drafts [including ALL draft versions] and final outgoing letters,draft [including ALL draft versions] and final Press Releases, drafts [including ALL draft versions] and final E Mails, Mobile Device and other TEXT messages,and any and all other forms of documents without limitation or exclusion;
  1. "Mayor" shall mean the Mayor of San Diego, and his employees, staff, consultants, advisers [whether employed or voluntary], legal counsel and political and press advisers ;
  1. "Councilperson" shall mean any current or former member of the San Diego City Council and their employees, staff, consultants, advisers [whether employed or voluntary], legal counsel and political and press advisers ; 
  1. "City" shall mean the City of San Diego;
  1. "City Attorney" shall mean the City Attorney of San Diego,and her employees, staff, consultants, advisers [whether employed or voluntary], legal counsel and political and press advisers; 
  1. "Direct Communication" shall mean as that term is defined at Section 27.3503 of the San Diego Municipal Code;
  1. "City Official"  shall mean as that term is defined at Section 27.3503 of the San Diego Municipal Code;
  1. "Jacobs Plan Project" shall mean the proposed Solicitation K-19-1704-DBB-3 for the Balboa Plaza de Panama Jacobs Project; and
  1. "Jacobs" shall mean Dr. Irwin Jacobs and his employees, staff, consultants, advisors [whether employed or voluntary], legal counsel and political and press advisors.

 

The following Public Records are requested:

  1. All Documents referring or relating to any meetings or communications between the Mayor and Jacobs regarding the Jacobs Plan Project from January 1,2016, through and including the date of your final response to this Request;
  1. All Documents referring or relating to any Direct Communication by or between the Mayor and Jacobs regarding the Jacobs Plan Project from January 1,2016 through and including the date of your final response to this Request;
  2. All Documents referring or relating to any meetings or communications between any Councilperson and Jacobs regarding the Jacobs Plan Project from January 1,2016 through and including the date of your final response to this Request; 
  3. All Documents referring or relating to the Jacobs Plan Project between any Councilperson and Jacobs from January 1,2016 through and including the date of your final response to this Request; 
  4. All Documents referring or relating to any rescheduling of the Bid Opening for the Jacobs Plan Project m including but not limited to from December, 2018, to January 9, 2019 to January 18, 2019 from November 2, 2018 through and including the date of your final response to this Request; and
  5. All Documents referring or relating to any Direct Communications , meetings, telephone calls or conferences or other communications between the Mayor, City Attorney ,any Councilperson and/or Jacobs and Bond Counsel for the Jacobs Plan Project from June 1, 2018 through and including the date of your final response to this Request.
