Re: Public records request related to Urban Area Security Initiative (UASI) grant application materials

 

To Records Administrator,

 

This is a request under the California Public Records Act on behalf of the American Civil Liberties Union of San Diego & Imperial Counties.

 

The ACLU seeks records relating to the resolution authorizing the City’s participation in the Fiscal Year 2018 and Fiscal Year 2019 Homeland Security Grant Program[1], specifically the Urban Area Security Initiative (UASI) Grant Program.

 

Records requested

We request the following records created after January 1, 2017:

  1. All UASI Grant Program application documents between the City of San Diego and any of the following agencies: the Office of Homeland Security, the California Governor’s Office of Emergency Services, the Mayor of San Diego, San Diego Council Offices, or the 18 incorporated cities in the San Diego Urban Area (SDUA).

All communications between San Diego city employees administering the UASI grant program[2] and the Department of Homeland Security, the California Governor’s Office of Emergency Services, the Mayor of San Diego, San Diego Council Offices, or the 18 incorporated cities in the San Diego Urban Area (SDUA).

If you determine that some but not all of the information is exempt from disclosure and that you intend to withhold it, I ask that you redact it for the time being and make the rest available as requested. In any event, please provide a signed notification citing the legal authorities on which you rely if you determine that any or all of the information is exempt and will not be disclosed. If I can provide any clarification that will help expedite your attention to our request, please contact me at (619) 232 2121.

 

Since this request is on a matter of public concern, we request a fee waiver. We also request that documents be provided in electronic format if at all possible. Doing so would eliminate the need to copy the materials and provides another basis for our requested fee waiver. However, if such a waiver is denied, please provide a signed notification citing the legal basis for the denial. Please also inform us of the reasonable costs prior to copying any materials. 

 

According to the California Public Records Act (California Government Code § 6253(c)), a response is required within 10 days. Thank you for your prompt attention to this matter. Please furnish all applicable records to the ACLU of San Diego & Imperial Counties at ctriplett@aclusandiego.org
