This is related to a previous Public Records Act Request # 16-2125 sent to the City Clerk and the Department of Public Works on or about September 9, 2006. The undersigned inspected the City's construction project documents on or about December 10, 2016 at the offices of the subject wastewater treatment plant. At that time, I was informed that the construction project was not yet fully complete and' that the City had recently sent a letter to the prime contractor regarding completion and liquidated damages.

DESCRIPTION OF REQUESTED RECORDS

1.All notices of default under the Contract issued by the Office of the City Attorney.

2. All claims issued by the Office of the City Attorney to Archer-Western for damages incurred for breach of the Contract, including but not limited to liquidated damages.

3. All correspondence from the Office of the City Attorney to Archer-Western concerning liquidated damages assessed under the Contract.

4. All correspondence to the Office of the City Attorney from Archer-Western concerning liquidated damages assessed under the Contract.

5. All non-privileged records of the Office of the City Attorney regarding the assessment of liquidated damages by the City of San Diego against Archer Western under the Contract.

6. All surety bond claims made by the City based upon any breach of the Contract.

7. All arbitration demands made by the City or any other person or entity alleging breach of the Contract.

8. All mediation demands made by the City or by any other person or entity alleging breach of the Contract.

9. All non-privileged correspondence from the Office of the City Attorney to any person or entity regarding construction defects, warranty work, punch list work, and failure to complete the performance of the Contract (or any of them).

10. All non-privileged correspondence from any person or entity to the Office ยท of the City Attorney regarding construction defects, warranty work, punch list work, and failure to complete the performance of the Contract ( or any of them).

11. All discovery responses, mediation briefs, arbitration briefs, trial briefs, Government Code Claims, Public Contract Code Claims, and non-privileged correspondence stating the dollar amount of damages sought and the basis therefor, in any mediation, arbitration, claim resolution process, or other alternative dispute resolution process, alleging breach of the Contract.
