We are writing on behalf  of California Unions for Reliable Energy ("CURE") to address the City of San Diego's ("City") ongoing failure to provide records in their native electronic format. 

On October 10, 2017, CURE submitted a request for all input and output modeling files (e.g., CalEEMod, AERMOD, HARP), emission calculations, and meteorological data in native electronic format related to the North City Project, Pure Water San Diego Environmental Impact Report/ Environmental Impact Statement ("EIR/EIS"), SCH #2016081016 / PTS #499621. This request was
assigned the following number: Public Records Request #17-2906.

On October 12th, the City provided us with some records, but only in PDF format, not in their native electronic format. We had explained in our October 10th letter that the native electronic format records were necessary to enable public review of the emissions calculations used in evaluating the air quality impacts for the North City Project.

On October 30th, we received unlocked excel spreadsheets as a partial response to Public Records Request #17-2906. However, we did not receive the input and output files for all CalEEMod, AERMOD, and HARP runs. We also did not receive meteorological data in native electronic format. As stated in our October 24th letter, the City has a duty to obtain these records and provide them to us.

Meanwhile the comment deadline of November 21, 2017 is in less than two weeks and the public has not received all documents referenced and relied upon in preparing the EIR/EIS. CEQA requires that all documents referenced in an environmental review document be made available to the public for the entire comment period. I Therefore, we reiterate our October 17th request for an extension of the comment deadline.
