Dear Ms. Maland,

Pursuant to the California Public Records Act (Gov. Code §6250 et seq), this firm hereby requests to inspect all public records the City of San Diego has pertaining to the above referenced City project.  This request is for the records generated subsequent to 6/7/15 and includes, but is not limited to the following types of documents:

  1. All documents relating to the design and construction of the project to include:
    1. All third party consultant contracts to any firm or firms engaged by the City for any design, investigative or construction management services related to the design and/or construction of the above referenced project. This includes all survey studies, geotechnical studies, structural analysis studies, and architectural services.  If the survey studies were performed internally by City personnel, as opposed to outside consultants, then this request includes all such survey documents.
    2. All records relating to any meetings between City personnel and the engaged 3rd party consultants relating to the design and the construction of the project.
    3. All design review comments including 10% through 100% design review stages.
    4. All Inspection Reports, Daily Reports, Inspector journals.
    5. All design Reports, Draft Reports, Memo’s, Meeting Minutes and Notes of telephone conversations.
    6. All Geotechnical Reports and Draft Reports.
    7. All Geotechnical Inspection Reports, Daily Reports, and Verification Anchor Test Data.
  2. All project related submittals and re-submittals during the design and construction phases of the project to include all City responses to said submittals and re-submittals.
  3. All communications between City employees and Hazard Construction to include:
    1. All Written communications.
    2. All Email communications (electronic format) with all attachments included in the email(s).
    3. Reports, Draft Reports, Memo’s, Meeting Minutes.
    4. All comments, annotations or objections to said Reports, or Draft Reports.
    5. Phone Records and Notes of Phone Conversations.
    6. All Change Order requests made by Hazard Construction Company (Hazard) and the City responses thereto.
    7. All Change Orders issued by the City.
    8. All RFI’s submitted by Hazard and the City responses thereto.
    9. All project related submittals, submitted by Hazard and all City responses thereto.
    10. All project schedules and schedule updates submitted by Hazard and the City responses thereto.
  4. All communications between City employees and third-party consultant(s) regarding the design, construction and or inspection of the project to include:
    1. All Written communications.
    2. All Email communications (electronic format) with all attachments included in the email(s).
    3. Reports, Draft Reports, Memo’s, Meeting Minutes.
    4. All comments, annotations or objections to said Reports, or Draft Reports.
    5. Phone Records and Notes of Phone Conversations.
  5. All communications between City employees regarding the design and construction of the project to include:
    1. All Written communications.
    2. All Email communications (electronic format) with all attachments included in the email(s).
    3. Reports, Draft Reports, Memo’s, Meeting Minutes and Notes of telephone conversation.
    4. Phone Records and Notes of Phone Conversations.
  6. All documents relating to the City’s engagement of Hazard Construction Company.
    1. All documents associated with the termination of APR Construction and Amtrust Surety’s takeover of the project.

In determining what records fall within the categories described above, please note that the Public Records Act (Gov. Code §6252) provides that public records include "any writing containing information relating to the conduct of the public's business prepared, owned, used, or retained by any state or local agency regardless of physical form or characteristics."  Further, "'Writing' means any handwriting, typewriting, printing, photostating, photographing, photocopying, transmitting by electronic mail or facsimile, and every other means of recording upon any tangible thing any form of communication or representation, including letters, words, pictures, sounds or symbols, or combinations thereof, and any record thereby created, regardless of the manner in which the record has been stored." 

Please inform us of the location of these records and when you would prefer we come in to inspect them, pursuant to Gov. Code §6253, stating the procedures to be followed when making your records available.  Also, please inform us whether your agency has adopted any regulations or guidelines for accessibility, pursuant to Gov. Code §6253.4, and if so, please provide us with a copy of those guidelines.

If you contend that any record within the categories of records described above is exempt from production, you must tell us you are withholding that record and must justify your conduct by citing the exemption, upon which you rely, as well as the names and titles or positions of each person responsible for the denial.  [Gov. Code §6253(d)]

Please note, this is not a request that any records be copied by you.  We will provide our own copy service to copy the records we want copied--after we have first inspected all the records.  We will also provide you with a large capacity hard drive on to which you can save the electronic media.  Please let us know where to deliver this drive.  Also, if the City uses Microsoft Outlook please provide the electronic email data in “PST” data format, if using IBM (Lotus) Notes please provide the electronic email data in “NSF” format. 

If we do not receive a written response to this request within 10 days of the date of this letter, we will seek a court order enforcing our right to inspect those records and for attorney fees.
