Upon review of Addendum “B” of the RFP for the Operation and Lease of the Presidio Hills Golf course I have a few questions for you or your office.

  1. 1. Addendum “B” seems to be questions and answers at some form of public meeting, could you please elaborate on the technical name of this meeting? 
  2. Has legal counsel been consulted concerning the liability of adding these questions and answers(addendum “B”)to the solicitation of bids, in most cases whom or what office is answering the questions is not identified and the author of Addendum “B” is not identified?
  3. Although my knowledge of Presidio Park is limited I did find some of the answers to be incomplete or evasive:
  4. Question 3- Please provide “all studies”, the answer refers to “A”,’B” and “C” with no disclaimer and trails off about the history of the “golf course”. Question “a” refers to  “Historic/Cultural Resources”,  I believed the response is inadequate or lacks a disclaimer.
  5. Question 5- Flooding, is it in a “flood Plain” or is it not, the current answer, again, could expose the City of San Diego to liability issues should the property be in a flood plain of any sorts now that someone is answering a direct question from I presume an applicant , it is not fair to the applicants to be this evasive on the flooding issue, it will have a big impact on at least one of the interested parties plans should the property be in a flood plain.
  6. Question 6- Flooding, storm water runoff volume, yes, the City of San Diego does have the flooding information, it is in a “Flood Plain” or it is not, please at least defer this question to your planning department.
  7. Question 13- Concerning redevelopment, “All proposals will be considered.” As a stand- alone sentence is worrisome beyond Mr. Marston’s deeded requirements on the property to be a golf course, this sentence is evasive or again opening up liability issues for the City of San Diego should the covenants not be disclosed to the applicant in good faith.
  8. Question 15- Consultation with Native Americans and Presidio Communities, the answer is “recommending  the applicant to consult “descendants”, I believe “descendants” refers to human remains located on the property covered by state and federal laws in addition to very concerned living relatives, again, this answer was very evasive and should either be explained in detail of removed. Recently I have learned that the Native Americans consider the entire Presidio Park as a “sacred” place, hopefully I will learn more of this as my knowledge of the property grows.

Could you please tell us who will be making the final decision concerning the award of the contract and the names and titles of the City of San Diego Real Estate Asset Department staff members/officials and please disclose if they have had any previous relationships or interactions, business or otherwise, with any of the current applicants for the current RFP for the Operation and Lease of Presidio Hills Golf Course?
