This request concerns violations of CA Penal Code 653m (harassment via electronic means). I'd like to know how many people in San Diego were sent to the City Attorney to be charged with this violation between 2010 to the present (or the most current date available). I checked with the District Attorney's office and they gave me their data, but said the City Attorney prosecutes these as well; the DA only prosecutes violations of this code when there is an additional felony attached.

Within these parameters, please detail the information as follows (as much of this detail that is available and/or doesn't violate confidentiality law, etc.):

 Of those charged, how many were not convicted (case dismissed, plea bargain, pretrial diversion program, etc.)?

  • Of those charged, how many went to trial and were not convicted (case dismissed, defendant won/prosecution lost, etc)?
  • Of those convicted, can tell me the sentence (jail, probation, fines, treatment, {counseling, substance abuse, etc} some combination, no punishment at all, etc)?
  • Age, sex, race of defendant
  • If available:
    • Courthouse trial held (downtown, East County, South Bay, etc.)
    • Name of prosecutor
    • Name of judge

Pursuant to your request all responsive documents have been released. The record titled “PRA 17-2438 – Booking Charge” contains the records you requested based upon the charges requested by the police department. The record titled “PRA 17-2438 – Complaint” contains the records you requested based upon the charges actually filed in a criminal complaint by the San Diego City Attorney’s Office. There is likely significant overlap between these two records. All of the cases for the San Diego City Attorney’s Officer that result in charges being filed in court are filed with the downtown courthouse.
