The Linda Vista Village of San Diego Home Owners Association (LVVSDHOA) requests that the Real Estate Assets Division make available any records (as defined by the State Public Records Act, including electronic correspondence, interdepartmental correspondence, phone transcripts, or US postal mail) that pertain to any amendments issued since 1997 to:
- the 1997 Lease for Linda Vista Village that the City and Tecolote Investors co-signed
(we have copies of the 1997 lease records and do not need the original records)
- the original enabling Conditional Use Permit for Linda Vista Village issued in 1979 approved by City Council and signed by the City Manager (we have copies of the 1979 records).
Our request includes just those records that have been proposed, heard, reviewed, voted on, or decided on, related to any amendment or amendments to those two documents, since 1997, by the City Attorney's office, the READ office, the Planning Department, the Planning Commission, or the City Council.
We already have copies of three Amendments to the Lease from the 1980's and do not require those documents. They are 1st (1980), 2nd (1983), and 3rd (1986). Repeat: We do not need copies of those first three Amendments.
The City staff recently was quoted in the Union Tribune that citizens have a choice about whether or not to use the "NextRequest" system which the City has hired to process public records requests. We do not want to use that system. We want to communicate directly with READ.
We anticipate a response from READ explaining how we may have access to any of the records requested, within ten days.
We are able to go in person to review paper records that are produced by READ in response to this request, at which time we might request copies be made of them, and to receive electronic copies sent care of the following member of the LVVSDHOA.
