This is a request under the California Public Records Act for records maintained by the City of San Diego. I request a copy of data concerning compliance with the city’s inclusionary affordable housing regulations (Municipal Code sections §142.1301-142.1311) including, but not limited to, the records described below, from Jan. 1, 2005 until the date this request is fulfilled:
- All reports received by City Council and the Housing Authority of the City of San Diego pursuant to §142.1311
I request these records be provided in an electronic, machine-readable format. Please include record layouts and any other information I may need to understand the records or format.
If the records are not maintained in an electronic format, please inform me before filling this request so that we can discuss my options for copy, delivery, or review in person at your offices.
Please comply with Section 6253.1 of the Government Code and assist me with this records request if necessary. As you know, the law requires you to provide suggestions for overcoming any practical basis for denying access to records that are sought. You are required to search you records and make reasonable efforts to seek clarifying information from me if it is necessary to help identify the records requested.
Where possible, I would like the data exported into columns and rows, and compiled in a Microsoft Excel spreadsheet or .csv file. The database manager should be familiar with this kind of basic export. Preferably, the file could be delivered via email, ftp, dropbox or another electronic means. If a disc needs to be shipped, please advise me beforehand so we can work out the details for delivery.
I request a waiver of all fees for this request, as I am using the information for newsgathering purposes and in the public interest. If you decide to charge a fee, please inform me beforehand so I can decide which records I would like to copy or view.
If you decide to deny any part of this request, please cite in writing your specific legal authority to do so, and specify which exemption(s) is (are) claimed for each field or data point denied. Then redact the information you wish to withhold, and provide the rest of the records as requested.
As you know, exemptions under the California Public Records Act are permissive, never mandatory. I ask that you waive any exemptions and release the records at your discretion and in the public’s interest. If you decide to withhold the information, please explain why you believe the public’s interest in confidentiality outweighs its interest in disclosure.
As I expect to appeal any denials, please specify the office and address to which an appeal should be directed, as well as a written description on how to appeal any denial.
